What Is Product Liability?
Product liability refers to legal claims that arise when an unreasonably dangerous or defective product injures a consumer (Tex. CPRC § 82.001). These cases may involve defects in a product’s design, errors made during manufacturing, or a failure to provide adequate warnings or instructions.
Common Product Liability Cases We Handle
Dangerous products can take many forms and paths to market. Our attorneys handle product liability cases involving all types of defective products, such as:
- Auto parts. We seek justice after car accidents and injuries caused by defective tires, car seats, seatbelts, and other vehicular defects.
- Children’s products. We help families pursue accountability for dangerous toys, defective cribs or bassinets, contaminated formula, and other children’s products.
- Medical equipment and devices. We pursue justice for injuries caused by defective medical products, such as hip implants and insulin pumps.
- Drugs. We handle cases involving defective drugs, tainted over-the-counter medications, and dangerous prescription medications.
- Furniture and household items. We pursue compensation for injuries resulting from defective chairs, sofas, beds, mattresses, and other household items.
What Qualifies as a Dangerous Product?
Manufacturers, distributors, or sellers may be held responsible in a product liability lawsuit when a dangerous product causes harm while being used as intended or in a reasonably foreseeable way.
There are three primary types of product defects:
Manufacturing Defects
A manufacturing defect occurs when a product departs from its intended design during production or assembly, such as airbags with faulty wiring or a power tool with a missing bolt. Manufacturing errors can occur even if the overall design is safe.
Design Defects
A design defect occurs when the product’s blueprint is inherently unsafe, creating a risk of harm even if the product is built as intended. Some examples include tools lacking essential safety features or toys with small parts that pose choking hazards.
Marketing Defects (Failure to Warn)
A marketing defect occurs when a product lacks adequate warnings or instructions about known risks, making it dangerous in its normal or foreseeable use. An example includes household chemicals lacking clear toxicity or ventilation instructions.
